(TSX-V: YOO, OTC: YOOIF), the industry's leading secure digital media distribution company, reported that in a ruling issued today the U.S. District Court of East Wisconsin granted summary judgement of non-infringement in favor of Destiny Media Technologies Inc. (OTCBB:DSNY) ("Destiny"), on the basis that Destiny's allegedly infringing conduct is beyond the territorial reach of U.S. patent law. YANGAROO has always believed, and continues to believe, that its claim against Destiny is meritorious.
In its submissions to the court Destiny stated that music uploaded to its system from the U.S. goes through its servers in Canada before being sent back into the United States. YANGAROO has an outstanding patent infringement claim for $15 million against Destiny in Canada for any infringing acts occurring in Canada.
"After winning the first motion in this action, we are disappointed with the Court's ruling on this second motion and are evaluating our options, including appeal, in light of this ruling.
